Cancellation by us
Until the time that we dispatch the goods to you, we reserve the right to reject or cancel your order with us. If we cancel your order we will notify you by
email and will credit you with any sum paid by you as soon as possible but in any event within 30 days of cancellation. We will not be obliged to offer you any additional compensation for disappointment suffered.
Your right to cancel your contract
You have the right to cancel your order within 7 working days from delivery. You must notify us of your intention to cancel within 7 working days from
delivery. After notification we will issue you a returns number that you must quote on the paperwork when returning the goods.
You cannot cancel your contract if the goods you have ordered are audio or video recordings or computer software (e.g. pre-recorded CD’s, DVD’s or tapes) and you have already taken the goods out of the sealed package in which they were delivered to you.
If you have received the goods before you cancel your contract then you must send the goods back to our contact address. Please provide notification by email if you wish to cancel your order, to support@fatmagpie.com, including your order number and date of purchase. Once we have received your email we will notify you of where to return the goods to. The products within the order are your responsibility until they reach us and the cost of returning the product to us is your responsibility. Once we have received the goods and checked that the product has not been used or damaged we will refund your payment within 30 days.
Once you have cancelled the contract then you must not use the goods and you must take reasonable care of them. We recommend you return the good to us using a suitably insured service. Goods must be returned 'AS SOLD' in the original packaging with all components and accessories. Goods must be complete, unused, and in 'AS NEW' condition (eg if you have opened the box to examine the product it must have been done so without damaging the box and packaging or damaging the product in any way) and must be re-packaged as received. We are unable to accept returns of un-wanted and non-faulty items after the 7 days. We can only accept the return of opened items if they are faulty.
If you cancel your contract but we have already processed the goods for delivery you must not unpack the goods when they are received by you and you must send the goods back to us. See above for instructions of what to do.
Once you have notified us that you are cancelling your contract, any sum charged to you will be re-credited to your account as soon as possible and in any event within 30 days of cancellation. If you do not return the goods delivered to you, or do not pay the costs of delivery, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.
Delivery of goods to you
We will deliver the goods ordered by you to the address you give us for delivery at the time you make your order. If the address you request is different from the billing address then we may contact you before dispatching the goods to confirm the delivery address specified by you. The cost of delivery of the goods will be set out in the online order form.
All orders for next business day delivery must be ordered before 3pm. For all other orders, we aim to deliver all products ordered within 2-5 working days of your order being accepted by us. Please note however that this is merely an estimate and we may not actually deliver within these timescales as this is dependent on stock levels. Nevertheless, delivery will be made as soon as possible after your order is accepted and in any event within 30 days of your order other than in cases where circumstances beyond our reasonable control delay delivery. For example, but without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
Liability
If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you
unless you notify us in writing at our contact address of the problem within 10 working days of the delivery of the goods in question.
If you notify a problem to us under this condition, our only obligation will be:
To make good any shortage or non-delivery; or
To replace or repair any goods that are damaged or defective; or
To refund you the amount paid by you for the goods in question in whatever way we choose.
Save as prohibited by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or
goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of
compensation other than to refund to you the amount paid by you for the goods in question under the circumstances set out above.
You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.
Nothing in these Terms is intended to limit any rights you might have as a consumer under applicable law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
